Grand Prize Drawing for Fifth Annual "Fish or Cruise" Sweepstakes
The Fifth Annual “Fish or Cruise” Sweepstakes (“Fish or Cruise” Sweepstakes) is sponsored by the Florida Wildlife Federation, Inc., 2545 Blairstone Pines Drive, Tallahassee, Florida 32301 ("FWF"). FWF is the source of funds used to award cash prizes or to purchase prizes. No reproduction of the “Fish or Cruise” Sweepstakes ticket forms is permitted. Only entries submitted on an official Florida Wildlife Federation ticket stub will be accepted. The Fish or Cruise” Sweepstakes Drawing will be held Thursday, June 22, 2017, at 3:00 p.m. at Florida Wildlife Federation Headquarters, 2545 Blairstone Pines Drive, Tallahassee, Florida, with the drawing supervised by Carroll and Co. Inc., Certified Public Accountants, 2640-A Mitcham Drive, Tallahassee, Florida 32308. All winners notified promptly. Payment not required to win. Presence at drawing not required to win.
The “Fish or Cruise” Sweepstakes begins on January 9, 2017, at 12:00 a.m. Eastern Standard Time ("EST") and ends on June 22, 2017, 12:00 p.m. (noon) EST. All entries must be at FWF Headquarters by 12:00 p.m. (noon) EST on June 22, 2017.
The “Fish or Cruise” Sweepstakes is open to all residents of the United States, including the District of Columbia and Puerto Rico, eighteen (18) years of age or older. Employees and Board of Directors of FWF, their advertising and promotion agencies, prize providers and their immediate family (defined as spouse, parents, children, siblings and grandparents) and household members of each are not eligible to enter. Void where prohibited by law. FWF reserves the right to verify, in its sole judgment, entrant eligibility. Entries are limited to individuals only; commercial enterprises and business entities are not eligible. By participating, entrant agrees to abide by these Official Rules and the decisions of FWF, which are final and binding in all respects.
HOW TO ENTER:
There are two (2) ways to enter the "Fish or Cruise" Sweepstakes:
* Enter by Mail:
Ticket contributions are $5 each. Six tickets for a $25.00 contribution. You can also order 15 tickets for $50, or 35 tickets for $100—your best value. Simply use the self-addressed envelope -- from an official FWF Fifth Annual “Fish or Cruise” Sweepstakes Mailing -- that you received in the mail to send in your check and completed ticket stubs. (We’ve enclosed six tickets in each mailing. If you’d like to purchase more, just enclose a check for $50 or $100 and we’ll fill out the additional tickets in your name!) If you receive multiple mailings for this “Fish or Cruise” Sweepstakes, please feel free to enter more than once or pass them on to a friend. Also, any person may request a set of six tickets without charge by sending a self-addressed, stamped envelope to the Florida Wildlife Federation, 2545 Blairstone Pines Drive, Tallahassee, Florida 32301, or, by sending your name and address to firstname.lastname@example.org. Requests must be received by June 8, 2017. No reproduction of the “Fish or Cruise” Sweepstakes ticket forms is permitted. All entries become the exclusive property of FWF, and will not be acknowledged or returned. Proof of sending or submission will not be deemed to be proof of receipt by FWF. FWF is not responsible for lost, late, incomplete, invalid, unintelligible, illegible, misdirected or postage-due entries, which will be disqualified.
* Enter Online:
(the "Website") and click on any of the icons for the Sweepstakes located throughout the site, including the Sweepstakes navigation at the top of every page. Follow the instructions to complete and submit the entry form including your name, address, city, state, zip code, phone and email address. Ticket contributions are $5 each. Six tickets for a $25.00 contribution, 15 tickets for $50, and 35 tickets for $100—your best value. Limit: Each entrant may enter only one (1) time per day. Maximum number of entries per person in the 2017 “Fish or Cruise” Sweepstakes is 50. Entrants are not permitted to share the same email address. Any attempt by any entrant to obtain more than the stated number of entries by using multiple/different email addresses, identities, registrations and logins, or any other methods will void that entrant's entries and that entrant may be disqualified. Use of any automated system to participate is prohibited and will result in disqualification. In the event of a dispute as to any registration, the authorized account holder of the email address used to register will be deemed to be the registrant or player. The “authorized account holder” is the person assigned an email address by an Internet access provider, online service provider or other organization responsible for assigning email addresses for the domain associated with the submitted address. The potential winner may be required to show proof of being the authorized account holder. FWF is not responsible for: incorrect or inaccurate entry of information by ticket holders; lost entries or transmissions; interrupted or unavailable network, server, or other connections; scrambled transmissions or other errors or problems of any kind whether mechanical, human, or electronic; technical malfunctions of the computer hardware, software, or any combination thereof; or problems associated with any virus or any other damage caused to ticket holders’ systems. Incomplete entries will be voided. All entries become the property of FWF.
By entering the “Fish or Cruise” Sweepstakes, you agree to these entry terms and the following legal conditions:
Selection and Verification of Potential Winner:
FWF will randomly select one (1) Grand Prize winner from among all eligible entries received, with the drawing supervised by Carroll and Co. Inc., Certified Public Accountants, 2640-A Mitcham Drive, Tallahassee, Florida 32308. One (1) replacement ticket is drawn at the end of the Sweepstakes Drawing in the event that for any reason the winner cannot be contacted. Grand Prize winner must comply with all terms and conditions of these Official Rules; winning is contingent upon fulfilling all requirements. The Grand Prize winner will be notified by phone call, mail or email after the drawing. The Grand Prize winner will be required to sign and return a Receipt indicating that the Grand Prize has been received, and to provide the following information to the Florida Wildlife Federation: the winner’s Name, Address, City, State, Zip Code, Phone Number, and Social Security Number. This Receipt must be received by the FWF Vice President of Administration within ten (10) calendar days of the receipt of the Grand Prize. FWF is required to report prize winnings of cash or prizes valued at $600.00 or more to the Internal Revenue Service. If cash prize is selected, allow 60 days for delivery of the cash prize. Winner has 16-months from date of drawing (i.e., through October 2018) to redeem their choice of a fishing trip to Sitka Point Lodge in southeast Alaska or their choice of a Cruise on a Costco Travel Cruise or $10,000. In the event Winner chooses one of the travel prizes, Winner shall make their own travel arrangements (including flights to and from cruise or fishing trip). Payment for trip expenses will be made directly to Winner, and Winner is responsible for paying for airline tickets, cruise tickets, lodging expenses, etc. from that sum. The maximum amount provided by FWF in fulfillment of a trip prize shall not exceed $10,000.00.
FWF reserves the right to substitute a prize with another prize of greater or equal value if a designated prize should become unavailable for any reason. Winners are solely responsible for all applicable federal, state and local taxes.
By accepting a prize, winners consent to FWF's use of their likeness, name, city and state for promotional and advertising purposes in any media without further payment or consideration.
FWF reserves the right, in its sole discretion, to modify or suspend the “Fish or Cruise” Sweepstakes should virus, bugs, tampering, unauthorized human intervention, fraud, technical failures or any other factor beyond FWF's reasonable control corrupt the administration, security, fairness, integrity or proper operation of the “Fish or Cruise” Sweepstakes. In such event, FWF reserves the right to award the prize from among the eligible entries received up to the time of impairment. FWF reserves the right, in its sole discretion, to disqualify any individual it finds to be tampering with the entry process or the operation of the “Fish or Cruise” Sweepstakes or to be acting in violation of these Official Rules. Any attempt by any person to deliberately damage FWF's website or undermine the legitimate operation of this “Fish or Cruise” Sweepstakes may be a violation of criminal and civil laws, and, should such an attempt be made, FWF reserves the right to seek damages from any such person to the fullest extent permitted by law. FWF's failure to enforce any term of these Official Rules shall not constitute a waiver of that provision.
By receipt of the prize, winner agrees that FWF, their employees, board of directors, sweepstakes coordinator, attorneys, their advertising and promotion agencies, prize providers, printers or mail houses, agents, or representatives (collectively, the “Companies”) are not liable whatsoever for any injuries, losses or damages of any kind resulting in whole or in part, directly or indirectly, from the acceptance, possession, use or misuse of any prize or from winner's participation in the “Fish or Cruise” Sweepstakes.
Limitations of Liability:
In no event will the Companies be responsible or liable for (1) incorrect or inaccurate information, whether caused by entrants, printing errors or by any of the equipment or programming associated with or utilized in the “Fish or Cruise” Sweepstakes; (2) technical failures of any kind, including but not limited to the malfunctions, interruptions or disconnections in phone lines or network, hardware or software; (3) unauthorized human intervention in any part of the entry process of the “Fish or Cruise” Sweepstakes; (4) technical or human error which may occur in the administration of the “Fish or Cruise” Sweepstakes or the processing of entries; (5) late, lost, undeliverable, damaged or stolen mail; or (6) any injury or damage to persons or property, including but not limited to entrant's computer, which may be caused, directly or indirectly, in whole or in part, from entrant's participation in the “Fish or Cruise” Sweepstakes, receipt or use or misuse of any prize, or from downloading any material from FWF's website, regardless of whether the material was prepared by FWF or a Fourth party, and regardless of whether the material is connected to FWF’s website by a hypertext link. Without limiting the foregoing, everything on the Companies’ sites is provided “as is” without warranty of any kind, either express or implied.
Further Limitations of Liability:
The Companies shall in no way be liable for and in any manner indemnify the Winner as to Costco Travel and Sitka Point Lodge prices, errors or changes, or their actions, or any arrangements the Winner may have with any and all aspects concerning the Winner and Costco Travel or Sitka Point Lodge or their agents. The agreement to utilize Costco Travel or Sitka Point Lodge shall be between the Grand Prize Winner of the 2017 Fish or Cruise Sweepstakes and Costco Travel or Sitka Point Lodge. The Companies specifically disclaim liability for any inaccuracies or typographical errors in Costco Travel and Sitka Point Lodge offers. The Winner is strongly advised to inquire with Costco Travel or Sitka Point Lodge as to all offers and requirements.
The “Fish or Cruise” Sweepstakes is governed by the laws of the United States and is subject to applicable federal, state, and local laws and regulations. Ticket holder agrees that any and all disputes that cannot be resolved with the Companies, and causes of action arising out of or connected with the “Fish or Cruise” Sweepstakes, shall be resolved individually, without resort to any form of class action, before a court of competent jurisdiction located in Leon County, Florida, which court shall apply the laws of the State of Florida without regard to rules of conflicts of law. In any such dispute, ticket holder shall, under no circumstances, be entitled to claim punitive, incidental or consequential damages, or any other damages, including attorneys’ fees, other than ticket holder’s actual out-of-pocket expenses (if any) associated with participating in the “Fish or Cruise” Sweepstakes. Ticket holder hereby waives all rights to have damages multiplied or increased.
